All use of the formals.io website, applications, information, services, and content distributed through or in conjunction with or made available on the platform is offered to you subject to your acceptance of these Terms and Conditions and our Privacy Policy.
The following terms and conditions incorporate a legal agreement between you ("You", "Customer", "User") and Kibuks LLC ("formals.io", "we", "our", "us") and set forth the terms and conditions by which formals.io will make its services available to electronically provide You with use of and access to the formals.io platform and services.
Company Information:
"Contract" means the contract between the Customer and formals.io for the Services in accordance with these Terms.
"Content" means any data, text, files, information, usernames, images, graphics, or other materials uploaded, downloaded, or appearing on the Services.
"Free Plan" means a free version of the subscription with certain limitations of use.
"Intellectual Property" means all patents, rights to inventions, utility models, copyright and related rights, trademarks, service marks, trade, business and domain names, rights in trade dress or get-up, rights in goodwill or to sue for passing off, unfair competition rights, rights in designs, rights in computer software, database rights, topography rights, moral rights, rights in confidential information (including know-how and trade secrets) and any other intellectual property rights, in each case whether registered or unregistered and including all applications for and renewals or extensions of such rights, and all similar or equivalent rights or forms of protection in any part of the world.
"Services" means the formals.io platform and all related services including, but not limited to, form creation, polls, quizzes, Q&A sessions, sprint poker, and any other features provided through the formals.io website and applications.
"Subscription Plan" means the periodically renewing plan selected by the Customer, setting out the Services to be provided (as well as the price and periodic basis for payment) in accordance with the Contract.
"Upgrade/Downgrade" means the upgrading or downgrading of the Customer's Subscription Plan to a different level, resulting in the availability of different features, the arising of certain limitations, and different amounts to be paid periodically by the Customer.
By accessing or otherwise using formals.io, You acknowledge that You:
If You do not acknowledge the above, You may not access or use formals.io. If You are dissatisfied with the terms, conditions, rules, policies, guidelines, or practices of formals.io, Your sole and exclusive remedy is to discontinue accessing or otherwise using the Services.
A Customer's registration or subscription through formals.io constitutes an offer by the Customer to purchase the Services in accordance with these Terms and Conditions. These Terms apply to the Contract to the exclusion of any other terms that the Customer seeks to impose or incorporate, or which are implied by trade, custom, practice, or course of dealing.
formals.io hereby grants to You a non-transferable, non-exclusive, revocable, and limited license for the term of this Agreement to access and use the formals.io Services strictly for the limited purposes, and under the terms and conditions, as are set forth in this Agreement.

formals.io shall, during the Subscription Term, use reasonable endeavors to provide the Services in accordance with the Subscription Plan in all material respects and subject to these Terms.
You acknowledge that from time to time, the Services may be inaccessible or inoperable for any reason, including:
You acknowledge that formals.io may from time to time, and in its sole discretion, update or change the content, features, or format of the Services. formals.io shall strive to provide reasonable advance notification of material changes where possible.
All payments for formals.io Services are processed through Paddle.com ("Paddle"), our authorized payment processor and Merchant of Record. By purchasing a subscription, you agree to Paddle's terms of service and privacy policy. Paddle handles all payment processing, invoicing, and related customer service for payment matters.
Payment may be made using the payment methods supported by Paddle, which typically include major credit/debit cards (Visa, MasterCard, American Express) and other regional payment methods as available.
The Customer shall make the first payment immediately upon purchase and thereafter on the renewal date of each billing period as set out in the Subscription Plan. The Customer agrees that, for each period, the amount set out in the Subscription Plan may be charged automatically.
Should the Customer decide to upgrade to a higher Subscription Plan, the upgrade will take effect immediately. Any remaining time on the previous plan will be prorated and credited toward the new plan.
Should the Customer decide to downgrade to a lower or free Subscription Plan, the current Subscription Plan will remain active until the end of the current billing period, at which point the downgrade will take effect.
If payment fails, formals.io may:
Refund requests are handled in accordance with Paddle's refund policy. Generally, due amounts paid by the Customer for subscription services are non-refundable. However, under distinct circumstances and in case of appropriate reasons for the Customer's dissatisfaction, partial or complete refunds may be considered on a case-by-case basis. All refunds, when approved, will be processed through Paddle using the original payment method.
Paddle, as the Merchant of Record, is responsible for calculating and remitting applicable taxes (VAT, sales tax, etc.) based on your location. The prices displayed may or may not include taxes depending on your jurisdiction.
Subscription prices are displayed in USD. Currency conversion, if applicable, is handled by Paddle.
"formals.io", the formals.io logo, and other identifying marks of formals.io are and shall remain the trademarks and trade names and exclusive property of Kibuks LLC, and any unauthorized use of these marks is unlawful. Other trademarks on the Services are the property of their respective owners.
Use of the formals.io Services is licensed, and not sold.
You retain ownership of any content you create using the Services. By using the Services, you grant formals.io a limited license to store, process, and display your content solely for the purpose of providing the Services to you.
You acknowledge that formals.io owns all right, title, and interest in and to the Services, and that You shall not take any action inconsistent with such ownership. Nothing contained in this Agreement shall be construed as granting You any ownership rights in or to the Services.
By agreeing to these Terms, You are expressly consenting to formals.io's collection, use, retention, and disclosure of information as set out in our Privacy Policy.
formals.io implements reasonable security measures to protect your data. However, no method of transmission over the Internet or electronic storage is 100% secure.
All payment information is handled securely by Paddle. formals.io does not store your complete payment card details.
The Services are provided "as is" and "as available", without any warranty of any kind. formals.io, its affiliates, agents, suppliers, officers, directors, and employees expressly disclaim any and all warranties, whether expressed or implied, including without limitation the warranties of merchantability, fitness for a particular purpose, and non-infringement of the rights of third parties.
formals.io does not guarantee or warrant:
In no event shall formals.io be liable for indirect, special, punitive, incidental, or consequential damages including, but not limited to, lost profits, lost data, or otherwise. formals.io's maximum aggregate liability to You, whether arising in contract, tort, strict liability, or otherwise, shall be limited to the amount of fees paid by You for the current subscription term.
You shall indemnify, defend, and hold harmless formals.io, its affiliates and subsidiaries, and their officers, directors, employees, and agents from any loss, damage, liability, or expense (including reasonable attorneys' fees) arising from:
The Contract shall commence on the date your subscription is activated ("Commencement Date") and shall be automatically renewed for each following billing period unless otherwise terminated.

formals.io reserves the right at any time to terminate this Agreement or withdraw the Services if it no longer can provide the Services or for any breach of these Terms by the Customer.

Notices shall be deemed received upon successful delivery.
formals.io shall have no liability to the Customer under the Contract if it is prevented from or delayed in performing its obligations by acts, events, or circumstances beyond its reasonable control, including strikes, natural disasters, war, civil unrest, failure of telecommunications networks, compliance with law or governmental order, or other causes beyond formals.io's reasonable control.
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and formals.io with respect to access to and use of the Services.
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision shall be deemed modified to the minimum extent necessary to make it valid, and the remaining provisions shall remain in full effect.
formals.io's failure to enforce any right or provision shall not constitute a waiver of such right or provision.
Nothing in this Agreement is intended to constitute a partnership, joint venture, or agency relationship between the parties.
You may not assign or transfer this Agreement without formals.io's prior written consent. formals.io may assign this Agreement without restriction.
These Terms have been drawn up in English. In the event of any conflict between the English version and any translation, the English version shall govern.
This Agreement, and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with Serbian law.
For Consumers: The courts of Serbia will have non-exclusive jurisdiction.
For Businesses: The courts of Serbia will have exclusive jurisdiction.
If you are dissatisfied with our Services, you may lodge a complaint by:
We are obliged to respond to your complaint without delay, and no later than within 30 days from the day of receipt of the complaint in writing or electronically. Our response will include a decision on whether to accept the complaint and a proposed resolution with timeline.
The deadline for resolving complaints cannot be longer than 90 days from the day of submission. If the complaint is valid, we will take appropriate action to resolve the issue.
